HOUSTON — Texans owner Janice McNair and her son, CEO Cal McNair, are doing what they can to keep some recent court filings under wraps.
They both want to have records sealed that were filed by Cary McNair, Cal's brother and Janice's other son, to take over his mother's estate.
Cary filed paperwork to get guardianship over Janice claiming that she was incapacitated. The application was filed in November and it was temporarily sealed. On Tuesday, there was a hearing to permanently seal it, but it's unclear what happened during that hearing.
According to records, Cary filed the application without his mother or brother's knowledge. Cal and Janice both said they were shocked at the "drastic and unwarranted measures of alleging his mother is incapacitated," according to court records.
Cary is "seeking to terminate her rights and appoint himself as her guardian to control her personal, financial, and medical decisions," court records said.
"Ms. McNair and Cal are firmly against an allegation or implication that Ms. McNair is incapacitated or needs a guardianship," the emergency motion to seal the records said.
The documents mention the Texans franchise as a reason for the courts to seal the records. Both Janice and Cal are directly involved with the NFL team.
"The details of this family dispute becoming public will have an impact on (their) ability to conduct business as it could create a needless-and baseless-media stir regarding the ownership and direction of the Houston Texans, affecting employees and business partners of the Houston Texans," records said.
Another hearing is scheduled for Jan. 26.
