DALLAS — Prosecutors Friday dropped the capital murder case against a man who was accused in the death of prominent Dallas lawyer Ira Tobolowsky.
As WFAA previously reported, Tobolowsky was found dead with blunt-force trauma after he and his home in North Dallas were set on fire in May of 2016.
The Dallas County District Attorney’s Office filed a motion to dismiss the charge against Steven Aubrey Friday, court records show.
“Upon review of all the facts associated with this case by the assigned Assistant District Attorney, it has been determined that the State is unable to make a prima facie case at this time,” the court filing read.
As we previously reported, Aubrey was named a person of interest in the case early on but wasn’t arrested until 2022. Aubrey was previously set to stand trial and didn’t appear in Dallas County Jail records Friday.
Tobolowsky was found dead in his burned garage on Kenshire Lane in North Dallas in May of 2016. His death was ruled a homicide by the Dallas County Medical Examiner's Office, which concluded that he died of thermal burns, smoke inhalation, and blunt force trauma.
Police said at the time that someone assaulted him, doused him in gasoline, and set him on fire.
