ALLEN, Texas — An Allen daycare is accused of allowing a preschooler to eat fish sticks despite knowing she has a severe food allergy, the child's family alleged in a lawsuit filed this month.
The 3-year-old's mother, Danielle Levy, claims it happened twice in a timespan of four months at the Allen Knowledge Beginnings daycare.
The second time it happened, the lawsuit says, Levy's daughter went into anaphylaxis, which is a severe allergic reaction. Levy says in the lawsuit, which was filed Feb. 8 in Collin County, that her daughter was found in a bathroom barely breathing with a swollen tongue, lips, and face.
The lawsuit claims the daycare did not contact emergency medical services or follow the girl's emergency allergy plan, but rather called the mother, who then called 911. First responders administered two EpiPens and gave the toddler an oral medication to combat her anaphylaxis while en route to the hospital, the lawsuit states.
First responders then told the mother, according to the lawsuit, if she had waited five more minutes to call 911 or tried taking her to the hospital herself, the young girl would have likely died of anaphylactic shock.
WFAA reached out to Allen Knowledge Beginnings about the incident. The daycare said it would not comment on pending litigation.
