FORT WORTH -- A 21-year-old man no-billed Wednesday in connection with the shooting of Fort Worth Officer Matt Pearce may still face criminal prosecution after the Tarrant County district attorney’s office quickly filed new charges in the case.
Tarrant County records show Ed Russell McIver Jr. of Weatherford was not indicted Wednesday on a charge of attempted capital murder and possession of a controlled substance, according to the Star-Telegram.
“We believe strongly this case should be prosecuted and have re-filed those two charges to be presented to the next Grand Jury,” said Samantha Jordan, a spokeswoman for the Tarrant County district attorney’s office. “It is not acceptable to fire upon police officers acting in the line of duty.”
Jordan said McIver will remain in the Tarrant County Jail based on the re-filing of the new charges.
Ed McIver, Jr., and his father, Ed McIver, Sr., led authorities on a wild chase in west Fort Worth Tuesday that resulted in a shootout. They were attempting to serve the elder McIver a number of outstanding warrants.
McIver Sr. was killed, and Officer Matt Pearce was shot seven times. McIver, Jr. evaded hundreds of officers for hours before finally being captured deep in the woods.
Police showed News 8 a rap sheet for McIver, Sr. that goes back decades, with assault, burglary, and theft, among other offenses, along with at least one prison sentence.
McIver, Jr. was jailed on multiple charges, including capital murder, after the shooting.
